Directors’ Conference of the State Media Authorities (DLM)

The Directors’ Conference of the State Media Authorities (DLM) manages joint matters of the state media authorities outside of their licence and supervision tasks and is responsible for awareness of the interests of member authorities on a national and international level.

The DLM manages the general topics in the area of audiovisual media and maintaining the exchange of information and opinions with broadcasting companies. It obtains expert opinions on matters of general media policy and economic significance, as well as analysing the development of programme content and technological requirements.

Once a year, the DLM hosts a symposium on various facets of regulation with high-calibre speakers from politics and the media industry. For this event, the DLM places its media policy focus on current key issues and, as the national decision-maker, also addresses international aspects of media policy.

Structure

In the DLM – as in the Commission for Licences and Regulation (Kommission für Zulassung und Aufsicht, ZAK) – the directors and presidents of the 14 state media authorities work together. A director is elected for a two-year term as committee chairperson of the ZAK. They simultaneously hold the position of DLM chairperson.

The ZAK and DLM complement each other in their responsibilities based on the Interstate Broadcasting Agreement and the ALM statute. Since they are comprised of the same members and their tasks are closely related, their meetings are regularly combined. The ZAK and DLM meet approximately ten times a year.

Their work structures are also identical: There are 3 specialist committees which do the groundwork for the boards. This measure creates synergies, utilises the expertise of the directors and specialists in the media authorities, and accelerates consensus-oriented decisions of the ZAK and DLM.

The directors have designated 2 representatives to fulfil special tasks: a European representative and a representative for die medienanstalten’s budget.

Committees of ZAK and DLM

There are 3 specialist committees which do the groundwork for the boards. This measure creates synergies, utilises the expertise of the directors and specialists in the media authorities, and accelerates consensus-oriented decisions of the ZAK and DLM. 

Committee for Regulation

The Committee for Regulation carries out preparatory work for the decision-making by the DLM and the ZAK with respect to licencing, programming & advertising supervision.

This especially involves settling fundamental issues relating to media legislation in the context of digitisation of broadcasting as well as convergence between broadcasting and the internet. For investigations regarding licencing and supervisory issues, the committee can call on the expertise of subject specialists in the individual state media authorities. These experts carry out the preparatory work for decisions to be made on a case-by-case basis in five-person validation groups and subsequently submit their recommendations, on the basis of which the ZAK makes its final binding decisions.

Committee for Infrastructure and Innovation

This committee deals with all matters that concern digitisation in broadcasting and the developments relating to the broadcasting channels of cable, satellite, terrestrial transmission and IPTV. These channels must be configured to allow equal and non-discriminatory access.

Consequently, the committee occupies itself with matters such as the transition to the new standard in terrestrial television DVB-T2 HD, matters that concern platform regulation and network neutrality. In cases of discrimination, programme makers contact the Media Authorities.

The committee is associated with a specific commission: the Technical Commission of the Media Authorities (TKLM). This is where the technical directors of the Media Authorities investigate issues regarding media technology and carry out preparatory work for the committee's principal decision-making. To this end, they maintain contact with network operators, the "Bundesnetzagentur" (federal network agency), programme makers and their associations. This includes the close monitoring of concrete legislative projects as well as technical investigations relating to transmission frequencies.
